Woodfin Board of Adjustment Meeting Recap: June 4, 2024
The Woodfin Board of Adjustment convened on June 4th, 2024, to address several items related to land use and development within the community. The meeting primarily centered around a request for a variance at 66 Lake Town Lane, but also included procedural updates and discussions regarding future land use planning. Attendance was limited to Board members, staff, the applicant for the variance request (Greg Close representing property owner Chris Burkhart), and one individual presenting on behalf of the applicant, Greg Rutherford.
The Board’s most significant decision was a unanimous approval of a variance request for 66 Lake Town Lane. The request concerned the height of retaining walls needed for construction on the property, which would reach up to 20 feet 6 inches. Following a detailed presentation by applicant representative Greg Rutherford, outlining the property’s topography and proposed landscaping plans, along with supporting information from staff member Ricky Hurley regarding sewer lines, the Board determined that the variance was warranted. The approval is contingent upon two key conditions: the retaining walls must be stained a natural grayish-brownish color to blend with the surrounding mountain landscape, and the variance will expire if a shed currently on the property is ever removed. The applicant committed to planting evergreen trees as part of the landscaping plan, further enhancing the visual appeal of the property.
Throughout the meeting, a key discussion point revolved around proper procedure for public comment. Board members repeatedly emphasized the requirement for individuals to demonstrate "standing" – meaning a direct and negative impact from a decision – before being allowed to speak during public hearings. This clarification underscores the Board's commitment to ensuring that only those directly affected by decisions have an opportunity to voice their concerns. Beyond the variance request, discussions briefly touched upon the surrounding area’s zoning and how proposed developments align with Woodfin's overall land use plan.
Community input was limited to Greg Rutherford’s presentation and explanation of the plans for 66 Lake Town Lane. No other members of the public were able to demonstrate standing and therefore did not participate in the public comment portion of the meeting.
Looking ahead, the Board voted to continue consideration of a major subdivision sketch plan (Item #4) until their next meeting in July. The date for this item has been adjusted to July 9th, at the request of the applicant. Staff will continue processing and preparing for this next discussion.
