Board of Adjustment Prepares for Zoning Appeals Hearings: A Recap
On December 15, 2022, the Board of Adjustment (BOA) convened a meeting focused on preparing for an upcoming series of hearings related to zoning appeals. The meeting, attended by board members, legal counsel (John Henning), and town staff (Shannon & Ricky), served as a crucial planning session to ensure the hearings run smoothly and adhere to legal requirements. This preparation is important for residents as it will directly impact how zoning decisions are reviewed and potentially altered, affecting property rights and community development.
The primary focus of the discussion was establishing a clear process for these quasi-judicial hearings, which require impartial decision-making based on presented evidence rather than general public opinion. Legal counsel emphasized the importance of following North Carolina law, which generally supports the “freest use of property” when interpreting zoning regulations. A significant portion of the meeting was dedicated to clarifying the legal framework, including defining "standing" (who can legally participate – individuals demonstrating a direct and specific harm from the zoning decision) and outlining rules against "ex parte" communications (private discussions that could unfairly influence board members).
The BOA made several key decisions regarding the scheduling and structure of the hearings. They approved a schedule spanning January 25th, 26th and 27th, with hearings commencing at 5:00 PM each day, capped by a four-hour time limit. Recognizing the potential for lengthy discussions, a backup schedule of February 1st and 9th was also established. Board members acknowledged the need for this time limit to maintain focus and ensure productive hearings, as previously discussed experiences had shown hearings could extend for up to 9.5 hours.
While this meeting was primarily a procedural discussion amongst the BOA and legal counsel, it has significant implications for residents. The Town Attorney will compile a comprehensive "record" of relevant documents (including staff reports and applications) for the board’s review, coordinating with all parties involved. Residents should be aware that these hearings will follow a formal quasi-judicial process, with limited opportunities for direct public comment during the hearing itself.
