Montgomery County Board of Adjustment Meeting Recap – December 11, 2024
On December 11, 2024, the Montgomery County Board of Adjustment convened a special meeting to address development-related matters impacting residents. The meeting primarily focused on two projects: the Biltmore Park Apartments and Clayton Crossing, both located in areas experiencing growth and change. This recap provides a clear overview of the discussions, decisions, and next steps for those interested in understanding these developments.
The meeting began with standard procedural items, including introductions and a review of conflict-of-interest procedures to ensure impartial decision-making. The most significant portion of the meeting centered on the Biltmore Park Apartments project (ZPH 2024-00025), a planned development initially approved in 2022, now transitioning from rental apartments to individual ownership. The developer sought approval for a special use permit and a deviation from parking requirements, as the proposed layout slightly encroaches into the public right-of-way. After considerable discussion, the Board approved the special use permit with several key conditions designed to address community concerns. These include a subdivision of the property, construction adhering strictly to the approved site plan, submission of a site plan review permit, and crucially, an agreement to create a playground of at least 600 square feet and provide deeded access to an overflow parking area with a minimum of 30 spaces, accessible via an ADA-compliant sidewalk.
The Board also addressed a related matter concerning Clayton Crossing (ZPH 2024-00038), also involving a parking deviation request stemming from changes made since the project’s initial approval. Concerns were raised regarding the potential impact on neighbors and future parking enforcement challenges, particularly given the shift from a rental to an owner-occupied model. Rather than approving the deviation immediately, the Board opted for continued discussion and requested that the developer explore alternative solutions such as utilizing impervious driveway materials and addressing stormwater permit modifications.
While no formal public comments were taken during the meeting, Board members voiced concerns about the potential impact of these developments on neighborhood quality of life and emphasized the importance of upholding zoning ordinances. The change in ownership structure for Biltmore Park Apartments was repeatedly identified as a significant factor contributing to the current parking challenges.
Looking ahead, several key action items were identified. County staff will provide the Board with minutes from the 2022 approval meeting for Biltmore Park Apartments to provide additional context. The developer will investigate the feasibility of using impervious driveway materials for Clayton Crossing, aiming to alleviate concerns about right-of-way encroachment. Finally, the Board acknowledged that the North Carolina Department of Transportation (NCDOT) will continue to monitor traffic conditions following Interstate 26 improvements and may require further action if issues arise.
This meeting underscored the complexities involved in development approvals, particularly when project plans evolve after initial approval. Residents can expect further updates as the developer explores alternative solutions for Clayton Crossing and as NCDOT monitors traffic conditions related to both projects. The Board’s decisions reflect a commitment to balancing development with the preservation of neighborhood character and quality of life.
