Morganton Board of Adjustment Approves Variance for New Bank Building
The Morganton Board of Adjustment convened on June 9, 2025, to consider a request from Morganton Savings Bank regarding their proposed new building at the corner of North Green Street and Patterson Street. This meeting, a quasi-judicial hearing focused on applying existing zoning regulations to a specific case rather than gathering broad public opinion, resulted in a unanimous decision that will allow the bank to proceed with their plans.
The primary matter before the Board was a request for a variance from the city's zoning ordinance concerning front setback requirements. Currently, regulations limit setbacks to 5 feet from the street; Morganton Savings Bank sought an increase to 35 feet along North Green Street. The applicant, Zachary Sabinka (RLA), explained that several factors necessitated this change. These included the unusual size of the property (1.42 acres, fronting three streets), significant elevation changes on the site (a 13.6-foot drop), an underground stormwater drainage line, and a commitment to ensuring ADA accessibility through an accessible pathway.
Following presentations from the applicant and Wendy Smith, Director of Development and Design Services for the City, the Board engaged in discussion. Ms. Smith highlighted how the variance aligns with the city's goals for pedestrian-friendly development, particularly in relation to the nearby Fontaflora State Trail. The Board members acknowledged the unique challenges presented by the property's topography and infrastructure, recognizing that adhering strictly to existing setback regulations would hinder the bank’s ability to create an accessible and functional building. Chair Thomas Ure emphasized the importance of adhering to North Carolina state statutes regarding variance approvals, noting that a four-fifths vote is required.
Ultimately, the Board voted unanimously (5-0) to approve Morganton Savings Bank’s variance request. This approval allows the bank to proceed with their building plans as proposed, including the adjusted setback along North Green Street. No members of the public chose to testify during the hearing, as is typical in these quasi-judicial proceedings.
Looking ahead, the approved variance clears the way for Morganton Savings Bank to move forward with their development. The city will continue working closely with the bank to ensure compliance with all other applicable regulations. This decision addresses unique site conditions and allows for a design that incorporates ADA accessibility, ultimately contributing to the revitalization of the downtown area.
