City of Morganton Board of Adjustment Approves Variances for Case Farms Project
On February 10, 2025, the City of Morganton Board of Adjustment convened to consider a single application from Case Farms (Case Number 01-25) regarding a proposed building project located on property bordering Rand Street and West Fleming Drive. The meeting, which followed established quasi-judicial procedures focused on applying existing zoning regulations to a specific case, resulted in the unanimous approval of all three variances requested by Case Farms. This decision allows the company to move forward with its construction plans, subject to incorporating design elements that align with the surrounding area.
The primary focus of the meeting was Case Farms’ request for variances related to challenges posed by Duke Power easements running through the property. The company sought relief from three specific zoning ordinance requirements: a reduction in the required front setback (from 50 feet to 20 feet), permission for a portion of the building, specifically a processing air unit, to reach 70 feet (exceeding the standard height limit of 65 feet), and modifications to the landscaping buffer between industrial (EID) and commercial (HID) zones. City planning staff, including Senior Planner Wendy Smith (Director of Development & Design Services), provided context and explanation regarding these regulations and the rationale behind Case Farms’ requests. William Pate, representing Case Farms, assured the board of their commitment to incorporating design elements like awnings and brickwork to ensure visual compatibility with the surrounding neighborhood.
Notably, no members of the public chose to testify or provide comments regarding the application during the meeting. The Board Chair emphasized the importance of a unanimous decision due to the absence of one board member, as required by state law for such proceedings. Johnny Carswell was welcomed as a new Board member representing extra-territorial jurisdiction. The board also approved the minutes from their previous meeting held on December 9, 2024.
Following the unanimous vote approving all three variances, Case Farms is now cleared to proceed with their construction plans. The Board of Adjustment will continue to operate under its established procedures for future cases, ensuring a consistent and fair application of the city's zoning ordinances. It’s important to remember that this meeting was a quasi-judicial proceeding, meaning decisions were based solely on the specific facts and evidence presented in this particular case.
