Town Council & Planning Board Training Recap: Understanding Zoning in Our Community

On August 27, 2025, the Town Council and Planning Board of Adjustment participated in a training session led by attorney Brian Golden from Van Winkle Law Firm, focusing on zoning principles and best practices. This session was designed to refresh the board's understanding of how zoning impacts our community and ensure future decisions are well-informed. While no formal votes or decisions were made during the training itself, the insights gained will directly influence how zoning matters are handled moving forward.

A core element of the training centered on clarifying the distinctions between "conditional zoning" and "conditional use permits." Conditional zoning allows developers to propose site-specific development plans that address how a project aligns with local ordinances and mitigates potential impacts. This is a legislative decision, giving the Town Council more flexibility in considering proposals. In contrast, conditional use permits involve a more formal quasi-judicial hearing process where evidence and expert testimony – such as traffic studies or stormwater assessments – are carefully considered. The training emphasized the importance of relying on qualified experts and their findings when making zoning decisions, acknowledging that while community input is valuable, it should be weighed against expert opinions and data.

Throughout the session, participants engaged in discussions about what zoning truly means for our town, ultimately agreeing it's a vital system to manage land use, promote public health and safety, and ensure orderly community development. A case study from Rockingham County involving a proposed casino development was used to illustrate the importance of following proper procedures and carefully considering potential impacts. The board also reinforced that they must consider all “reasonable considerations,” even if those contradict expert testimony, ensuring a fair and thorough review process.

The training included opportunities for public comments and questions from attendees, reflecting the board's commitment to transparency and community engagement. Residents shared their perspectives on zoning, raising concerns about property rights alongside the need for responsible development. In response to this feedback, town staff are considering developing a brief preface for public comment periods during zoning hearings to clarify the purpose and scope of these discussions.

Ultimately, this training equips our Town Council and Planning Board with a stronger understanding of zoning principles and procedures. Residents can expect to see this knowledge applied in future decisions, leading to more informed and consistent outcomes that balance community concerns with development needs and legal requirements. The board’s commitment to relying on facts, expert testimony, and considering all reasonable perspectives will contribute to a more transparent and equitable zoning process for everyone in our town.
