Town Council Addresses Urgent Flat Creek Stabilization Project

The town's role will involve coordinating the grant application, overseeing construction (leveraging experienced staff), and ensuring compliance with all relevant regulations.
During the meeting, resident Warren Edus voiced a significant concern regarding potential liability for the town should issues arise during or after construction. This prompted a discussion about incorporating a co-party agreement with WEBS, which will require legal review to ensure it adequately protects the town. The proposed solution involves installing bulwarks and geolifts along approximately 95% of the affected stream bank, which falls within town right-of-way.
Following robust discussion, the Council unanimously approved a resolution authorizing the Town Manager to execute an agreement with WEBS and Quiblin Associates, consistent with a memorandum from May 5, 2024. This empowers the Town Manager to sign necessary documents and secure legal approval of the agreement's final form, directly addressing concerns about liability.
