Board of Adjustment Approves Key Land Use Projects in Morning Session

The Buncombe County Board of Adjustment convened a special called meeting this morning, June 10, 2026, to address three distinct land use requests. Following a quasi-judicial process emphasizing adherence to county zoning ordinances, the Board unanimously approved all three proposals, marking a productive session focused on balancing development with community considerations.

First, the Board approved a Special Use Permit for ArtSpace Charter School's "Spark Learning Center," a new 4,750 square foot facility planned for 104 Sherwood Road. This approval will allow the school to expand its hybrid virtual learning program, a development Dr. Serena Fuller, Executive Director of ArtSpace Charter School, emphasized as crucial to meeting evolving family needs. Next, the Board approved a request from Plot Hound LLC, owned by Joseph Kruger, to add one single-wide manufactured home unit to the existing Willow Court and Moonshadow Lane Mobile Home Parks located at 18 Willow Court. Kruger described the expansion as a straightforward addition to an established mobile home park, and the Board readily agreed. Finally, Christ School received unanimous approval for a Special Use Permit related to their planned unit development (PUD) Level One, encompassing 12 new faculty housing units and a new academic building. A minor modification regarding ADA compliance was incorporated into the approval to ensure accessibility standards are met.

While all three cases generated significant interest, public participation was limited. No individuals asserted standing in any of the cases and despite being informed they could offer lay testimony, no public comments were presented during the hearings. This suggests a level of confidence in the applicant’s proposals and their alignment with community interests, or potentially limited awareness of the proceedings.

Looking ahead, several key action items will guide implementation of these approvals. Rachel Cron (Wade-Shrim) must now submit a site plan review permit for the Spark Learning Center project before any construction begins. Joseph Kruger will proceed with the Willow Court expansion, and legal staff will prepare a formal order reflecting this decision. For Christ School, the next step involves submitting and receiving approval for a recombination plat with new pins reflected in the Buncombe County GIS before initiating site plan review applications. Additionally, Christ School must construct a solid visual barrier fence along the eastern side of their property. Legal staff will finalize and record official orders reflecting all decisions, with the Board reconvening at 1:00 PM for the afternoon session.
