On October 8, 2025, the Buncombe County Board of Adjustment convened to discuss several development proposals impacting residents. The meeting, attended by board members and county staff, focused primarily on special use permits related to new commercial construction and existing business redevelopment. A key aspect of the meeting was a strong emphasis on adhering to zoning regulations and ensuring decisions are based on factual evidence, reflecting the quasi-judicial nature of these proceedings.
A significant decision made during the meeting was the unanimous approval of a special use permit for a proposed new grocery store and strip retail development on Hitching Post Road. This project, which includes a 50,325 square foot grocery store and 7,080 square feet of retail space, will also necessitate a new signalized intersection and improvements to existing access points. Staff recommended approval contingent on securing necessary permits related to subdivision, floodplain management, and stream rerouting – all crucial considerations for responsible development within Buncombe County. Traffic engineers presented findings from a traffic impact study, outlining planned intersection improvements to accommodate the anticipated increased traffic flow.
The meeting also included a discussion regarding the redevelopment of an existing Ingles grocery store and related facilities (including a gas station and car wash) on US 70 in Swannanoa. This case, known as Ingalls Number 34, faced a delay due to the absence of the property owner and questions surrounding proper representation. The Board ultimately voted to continue this case until November 12th, requiring either the owner’s presence or representation by an attorney. This postponement ensures due process and allows for proper consideration of the variance request to reduce the front setback requirement, a point that generated considerable discussion. The board acknowledged the impact of recent severe weather (Hurricane Helene) on the Swannanoa area, noting that this would be considered in evaluating the proposal.
While no public comments were formally received during the meeting, board members reiterated their commitment to transparency and encouraged community engagement in future quasi-judicial proceedings. They also clarified the limitations on testimony, emphasizing that opinions and projections should be supported by evidence.
Looking ahead, several action items were identified. Case ZPH 2025-00031 (Biltmore Market Gardeners Cottage Flood Variance) will be addressed in November. The applicant for the New Leicester Grocery project must now finalize and submit all required permits, including those related to floodplain development. Finally, staff will investigate providing interpretation services for applicants in future meetings, ensuring equitable access to the process for all. Residents can expect further updates on these developments at the next Board of Adjustment meeting scheduled for November 12th.
