The City of Asheville Board of Adjustment convened a public hearing on Monday, October 47, 2025, at 2:00 p.m. in the First Floor Conference Room of City Hall. The meeting primarily focused on two variance requests submitted by Kevin Westmoreland related to flood hazard reduction standards within the Unified Development Ordinance (UDO), both concerning historic structures damaged by Hurricane Helene. The Board also addressed administrative items, including approval of minutes from a previous meeting.
The core discussion centered on two separate requests for variances to flood regulations at properties located at 3 Boston Way (PIN 9647-79-0891) and 4 All Souls Crescent (PIN 9647-79-1826). Both properties are historic buildings, contributing resources to the Biltmore Village Historic District and listed on the National Register of Historic Places. The requests aim to allow repairs and upgrades to these structures without fully complying with current flood protection standards, prioritizing the preservation of their historic character. The proposed work includes upgrading electrical and HVAC systems with flood-resistant materials at both locations, as well as interior finishes. No new construction or exterior changes are planned.
City staff presented detailed reports outlining the properties, proposed work, and rationale for the variances. The reports emphasized that strict adherence to current flood regulations would negatively impact the buildings' historical significance and designation. Staff referenced FEMA guidance for historic structures, which allows exemptions under certain conditions, and outlined a four-step process the Board would follow to evaluate the requests. The reports highlighted that neither applicant is proposing extensive exterior modifications or flood gates, focusing instead on internal upgrades and elevating existing systems.
The Board of Adjustment will need to determine if granting the variances meets specific criteria related to hardship, public safety, and compliance with local laws. The Board will review whether all prerequisites and special requirements have been met, ensuring the variance won’t increase flood risks or contradict the city's floodplain management goals.

The Board of Adjustment will deliberate on the variance requests and make a decision at a future meeting. The next regularly scheduled Board of Adjustment meeting is slated for January 26, 2026, as outlined in the 2026 DRAFT BOA Schedule. The schedule and associated fees (variance: $520, interpretation/appeal: $832) were also presented.
