Craig Fronzi, representing the company, presented testimony outlining these challenges. Following a presentation of findings from tax staff confirming the late filing and adherence to North Carolina General Statute 105-312h, the Board ultimately voted to deny the appeal and uphold the penalty. Board Chair Randall Barnett acknowledged the complexity of the situation, noting that while unintentional, it represented a significant oversight.

The second appeal came from Chai Pani Grove Park, LLC, who sought a waiver of a $1,030.24 penalty for unpaid business personal property taxes spanning 2021-2023. Anne Grover, representing the company, explained that the oversight was an honest mistake resulting from a business closure transition. Despite Grover's assurances of their commitment to timely tax filings at other locations, the Board also voted denied the appeal and upheld the penalty. Members emphasized the importance of consistent application of tax regulations, even when unintentional errors occur.

Beyond these appeals, the meeting began with the approval of minutes from the June 16th meeting. No public comments were offered outside of those related to the appeals under consideration. The Board’s decisions underscore their commitment to upholding established tax procedures and ensuring consistent application of regulations across Buncombe County.

Looking ahead, the Assessor's Office will continue the billing process for both General Equipment Rental Company and Chai Pani Grove Park, LLC. For General Equipment Rental Company, the final balance (including the penalty) is due by December 31st. The Board has scheduled their next meeting for August 18th at 1:00 PM, with an agenda and supporting documents to be distributed beforehand.
